Purpose

The Website provides Users information on the services offered by AERTEC and on the Company itself. By accessing this Website or using it in any way, you are considered a “User” and you accept this Legal Notice in its entirety without any reservations. The User should carefully read the content of the Legal Notice every time they intend to use the Website, since its content is subject to changes.

Some services on the Website may be subject to specific conditions that, where applicable, replace, supplement and/or amend this Legal Notice and must be accepted by the User before the corresponding service is provided.

General access to and browsing through the Website does not require Users to register, except for those features and/or services that do require it, in which case it will be necessary to provide certain information through the forms made available for this purpose.

Industrial & Intellectual Property

The User acknowledges and accepts that all the content displayed on the website, and in particular the designs, texts, images, logos, icons, buttons, software, trademarks, brands, and any other signs that may be used for industrial and/or commercial purposes are subject to Intellectual Property rights, and all brands, trademarks and distinctive signs, and all the industrial and intellectual property rights to the contents and/or any other elements inserted on the page, are the exclusive property of AERTEC and/or third parties, who have the exclusive right to use them in the course of trade.

As a result, the User undertakes not to reproduce, copy, distribute, make available or otherwise publicly communicate, transform or modify said content, holding AERTEC harmless from any claim arising from a failure to comply with these obligations. Under no circumstances does accessing the Website imply any type of waiver, transmission, licence or transfer of these rights, in whole or in part, unless expressly specified otherwise.

This Legal Notice does not confer upon Users any other right to use, alter, exploit, reproduce, distribute or publicly disclose the Website and/or its Contents other than as expressly provided for herein. Any other use or exploitation of any rights shall require a prior express authorisation specifically granted for this purpose by AERTEC or the third-party owner of the rights affected.

The content, text, photographs, designs, logos, images, computer programs, source codes and, in general, any intellectual creation present in this site, as well as the site as a whole, as a multimedia artwork, are copyright protected by intellectual property laws. AERTEC owns the elements that comprise the look and feel of the website, the menus, navigation buttons, HTML code, texts, images, textures, graphics and any other content on the Website, or it has the corresponding authorisation to use these elements.

Users shall not delete, circumvent and/or manipulate the copyright or any technical protection devices, or any information mechanisms that may be present within the content. The User of this Website undertakes to respect the rights listed herein and to avoid any action that could harm them. AERTEC reserves the right to exercise all legal means or actions available to it in defence of its legitimate intellectual and industrial property rights.

The service to access the Website may include links that allow the User to access other websites and portals outside AERTEC. In these cases, AERTEC does not control and is not responsible for any of these sites or their content, since it is acting as a provider of intermediary services in accordance with Article 17 of the LSSICE, and is only responsible for the content and services provided on the links if it is effectively aware of the illegality thereof and has not disabled the link with due diligence.

AERTEC is not responsible for the third-party websites that may be accessed via links, or for any content made available by third parties.

Users are solely responsible for clicking on links to or accessing external websites. AERTEC does not endorse or guarantee any of the information obtained by or through a link, nor is it responsible for any loss, claim or injury resulting from using or misusing a link, or for the information obtained through it, including other links or websites, for any interruptions in the service, or when attempting to use or misuse a link, whether when accessing the Website or when accessing information on other websites from the Website. The establishment of any type of link from the Website to an external website shall in no case entail the existence of any kind of relationship, collaboration or dependence between AERTEC and the owner of the external website.

If AERTEC is aware that the activity or information that is accessible at said links is illegal, constitutes a criminal offence or may injure the property or rights of a third party, it shall act with the necessary diligence to delete or disable the corresponding link as soon as possible. Similarly, if the User has effective knowledge of the illegality of the activities carried out through these third-party websites, he/she must immediately notify the Company so that it can disable the access link to said websites.

Reproducing the content of the Website on a third-party site, including it as part of its website or within one of its frames or to create a browser requires the express prior consent of AERTEC.

Privacy and personal data processing

The User may visit this website without providing any personal data; however, there are several options for sending in comments or forms in which personal data is collected and processed. When it is necessary to provide personal data to access certain content or services, the User guarantees that said data will be truthful, accurate, authentic and valid. AERTEC has internal procedures to enforce the obligations set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), and the relevant national data protection law.   • Introducing or disseminating computer viruses or any other physical or logical system that may cause damage to the physical or logical systems of AERTEC, its vendors or third parties.
  • Trying to access, use and/or manipulate data from AERTEC, third parties or other Users.
  • Reproducing or copying, distributing, or allowing the public to access the content through any form of public communication, transforming or altering the content, unless authorised by the holder of the corresponding rights or if this is legally permitted.
  • Deleting, concealing or manipulating the text on the intellectual or industrial property rights and other data identifying the rights of AERTEC or third parties incorporated into the contents, or the technical protection devices or any information mechanisms that may be inserted into the contents.

If any type of credential or password is generated to access any of the services and/or content of the Website, the User agrees to use it diligently and to safeguard it at all times. As a result, the User shall be responsible for keeping said credentials secret and undertakes not to disclose it to third parties, temporarily or permanently, nor allow third parties to access the aforementioned services and/or contents. Similarly, the User agrees to notify AERTEC of any event that could involve the improper use of his/her password, such as, for example, theft, loss or unauthorised access, so the password can be immediately cancelled. As a result, until the User makes said notification, AERTEC will be exempt from any liability that may arise from the improper use of his/her password, and the User will be liable if any illegitimate third party uses the contents and/or services of the Website for illegal purposes.

AERTEC will not be liable if it is impossible to provide the service due to an extended interruption of the electricity grid or telecommunications lines, or to social conflicts, strikes, rebellion, explosions, floods, acts and omissions of the government and, in general, any cases of force majeure or unforeseen events.

Security

AERTEC uses technologies that reflect the current state of the art to protect the User’s personal data and information, and our Website is hosted on secure servers protected against the most common types of attacks. AERTEC has adopted technical and organisational measures that take into account the state of technology, the nature of the stored data and the risks to which it is exposed in order to guarantee the security of personal data and prevent its alteration, loss, and unauthorised processing or access.

Changes to these conditions

AERTEC reserves the right to expand, modify, replace and/or cancel our Services and/or the terms of this Legal Notice with no prior notice. Doing so shall not result in any liability for, nor require compensation from, AERTEC, provided this does not affect the substantive conditions of the service provided, in which case we will inform you of any changes that have occurred by email to the email address provided during the registration.

Dispute resolution. Applicable law and jurisdiction

Any disputes or issues related to this Website or to the activities carried out herein shall be settled in accordance with Spanish law, to which the parties expressly submit. Any conflicts arising from or related to its use shall be decided by the Courts and Tribunals of the city of Málaga, unless the user is a consumer, in which case the Courts and Tribunals of the consumer’s place of residence shall have jurisdiction. 

Similarly, if the user is a consumer, the parties may submit their dispute to arbitration, as provided for in the law of arbitration and the defence of consumers and users, and to out-of-court dispute settlement procedures that are established through codes of conduct or other instruments of self-regulation.
